November 16, 2006

The Richfield Township Board of Trustees met for their regular meeting on November 16, 2006 at 7:10 p.m. with the following in attendance:

Shano Cica-Mraz, Trustee Chairperson
Laurie Peters Gilmore, Trustee
Dave Wyatt, Trustee

A motion was made by Ms. Cica-Mraz & seconded by Mr. Wyatt to open the scheduled public hearing to discuss zoning amendments. The motion passed with unanimous approval.

A recommendation had been made by the Zoning Commission at their October 12, 2006 meeting to approve zoning amendment for a rezoning of a portion of Parcel # 48-02357 from R-4 Planned Residential District to R-1 Rural Residential district. The rezoning is recommended because a relocation of Wheatley Road has left a .13 acre portion of isolated R-4 land on the south side of Wheatley Road, and this property is now proposed for use as the entry to a subdivision located primarily within the Village of Richfield in an R-1 District. A motion was made by Mr. Wyatt and seconded by Ms. Cica-Mraz to approve the rezoning of this property from R-4 to R-1, which will be effective thirty days from today. The motion passed with unanimous approval.

The Trustees were scheduled for Public Hearing discussion of two other zoning amendments, but the Zoning Commission is still in discussion of both items. One proposed amendment is to the LI-O District language for Site Plan Review Procedures, Section 420-6. The other proposed amendment is to the LI-O and C-2 District language for commercial nurseries and wholesale garden centers. A motion was made by Mr. Wyatt and seconded by Ms. Cica-Mraz to recess the public hearing on these two issues until the December 21, 2006 Trustees regular meeting to allow the Zoning Commission time to make a recommendation. The motion passed with unanimous approval.

A motion was made by Ms. Cica-Mraz and seconded by Mr. Wyatt to approve the minutes of October 19, 2006, as amended. The motion passed with unanimous approval.

Mr. Wyatt provided the Park report. The Rising Valley Park is recovering from summer usage. An Oviatt Road ditch near the park was eliminated with permission of the township, but the work was not done properly and runoff is washing onto Oviatt Road. Corrections will be made this coming spring. Township representatives met with Ruth Jocek, Recreation Director for the Village of Richfield and the Revere Schools athletic director regarding park & sport field usage. A use policy and fee schedule should be developed for park usage.

Ms. Gilmore provided the Roads report. The implementation of a township road-opening permit process was discussed. County and state agencies typically are against the enclosure of ditches, due to storm water management issues and the difficulty of evaluating the functioning of nearby septic systems, which may drain to rights-of-way.

Ms. Pinney joined the meeting at 7:45 p.m. and provided the Zoning report. She had just come from the Summit County Planning Commission meeting, where the Glencairn Forest revised preliminary plan had been approved with a number of conditions and the Richfield Industrial Park (LI-O District) preliminary plan had be given a time extension to allow resolution of several issues before an approval decision will be made.

In New Business, the Trustees discussed appointment to the zoning boards for 2007. A motion was made by Ms. Cica-Mraz and seconded by Mr. Wyatt as follows:
1. Appoint new members Douglas Mory and John Myers as alternates to the Zoning Commission for a one-year period.
2. Appoint Arlene Pepera, who is currently a Zoning Commission alternate, as a full member, to serve the balance of Gene Kulp’s term, which ends in 2009. Mr. Kulp became ineligible after moving from the township.
3. Appoint Natalie Grubb, who is currently a Zoning Commission alternate, to a one-year alternate term on the Board of Zoning Appeals
4. Appoint Frank Aveni, who is currently an alternate on the Board of Zoning Appeals, as a full member, to serve a five-year term ending in 2011.
5. Appoint Mike Fremon, who is currently an alternate on the Board of Zoning Appeals to an additional one-year term as alternate.

The motion passed with unanimous approval. The Trustees thanked Gene Kulp and Bill Spann, who has chosen to leave the Board of the Zoning Appeals at the end of his term, for their service to the township.

A motion was made by Ms. Gilmore and seconded by Ms. Cica-Mraz to go into executive session to discuss land acquisition. The motion passed with unanimous approval.

A motion was made at 8:45 p.m. by Ms. Cica-Mraz and seconded by Mr. Wyatt to go out of executive session and adjourn. The motion passed with unanimous approval.
