RESOLUTION #17-2001

WHEREAS, the amount of taxes which may be raised within the ten-mill limitation by levies on the current tax duplicate will be insufficient to provide an adequate amount for the necessary requirements of the Township; and

WHEREAS, it is necessary to levy a tax in excess of such ten-mill limitation for the purpose of providing funds for the general construction, reconstruction, resurfacing and repair of roads and bridges;

NOW, THEREFORE BE IT RESOLVED, by the Board of Trustees of Richfield Township that:

SECTION 1:  The question of the necessary levy for the purpose of providing funds for the general construction, reconstruction, resurfacing and repair of roads and bridges be submitted to the electors of the unincorporated areas of Richfield Township at the Election to be held on the sixth day of November, 2001.

SECTION 2:  The ballot form for such election shall be as follows:

A MAJORITY AFFIRMATIVE VOTE IS NECESSARY FOR PASSAGE

A replacement of .83 mills of an existing levy and an increase of 1.17 mills to constitute a tax for the benefit or Richfield township for the purpose of general construction, reconstructiion, resurfacing and repair of roads and bridges at a rate not exceeding 2 mills for each one dollar of valuation which amount of $.20 for each $10-0 of valuation for five (5) years commencing in 2001, first due in calendar year 2002.

SECTION 3:  The additional levy herein provided for, if approved by a majority of the electors voting on the question at the primary election of the 6th day of November, 2001 shall be for a period of five (5) years and shall be included on the 2001 tax list and duplicate for the first collection in 2002.

SECTION 4:  The Clerk is hereby directed to certify a copy of this Resolution to the Board of Elections of the County of Summit immediately after passage for the submission of the ballot question herein contained to the electors of unincorporated areas of the Township pursuant to the provisions of Sections 5705.19(G) and 5705.25 of the Revised Code, as applicable.

SECTION 5:  All formal actions of the Board concerning and relating to the adoption of the Resolution were made at an open meeting of this Board and all deliberations of the Board any of any of its committee that resulted in such formal action were in meetings open to the public in compliance with legal requirements.

SECTION 6:  The Resolution shall go into immediate effect upon its passage and no publication of same is necessary other than that provided for the notice of election.
