RESOLUTION #23-2001

A RESOLUTION OF THE RICHFIELD TOWNSHIP BOARD OF TRUSTEES TO AUTHORIZE THE ELIMINATION OF THE TAX LEVY WHICH IS NO LONGER APPROPRIATE AS A RESULT OF CONTRACTING FOR ALL POLICE SERVICES WITH THE VILLAGE OF RICHFIELD

WHEREAS, the Township currently has three separate police tax levies to fund police protection for the Township, and;

WHEREAS, the Township Trustees have entered into a Police Services Agreement under which the Village of Richfield will provide all police protection for the Township, and;

WHEREAS, the levy passed on May 3, 1994 attached hereto and incorporated herein as Exhibit "A" authorized an additional tax at the maximum millage of 1.8 mills for the benefit of Richfield Township for the purpose of providing funds directly in the operation of the police department and did not state that the revenues raised could be used to fund a contract for police services as was expressly authorized in the levy passed in November of 1983 and the levy passed on May 2, 1989, attached hereto and incorporated herein as Exhibits "B" and "C" respectively,

NOW, THEREFORE BE IT RESOLVED, by the Board of Trustees of Richfield Township, Summit County, Ohio, that the Township's legal counsel and Township Office Administrator take such action as is necessary to eliminate the levy that is attached hereto as Exhibit "A", the purpose of which has ended as a result of the Township's contracting for all police services from the Village of Richfield.  The elimination of this levy is to be reflected in the tax payment to be issued and payable beginning in January, 2002.
