RESOLUTION #6-2001
RESOLUTION AUTHORIZING THE BOARD OF TOWNSHIP TRUSTEES TO ENTER INTO A RIGHT-OF-WAY USE AGREEMENT WITH METRICOM, INC.
WHEREAS,
the Township has negotiated a Use Agreement with Metricom, Inc. (the "Agreement") (a copy of which is attached as exhibit A and incorporated into this Resolution by reference) to install, operate and maintain a mobile digital data communications radio network known as Ricochet on facilities located in the rights-of-way of Township roads.NOW, THEREFORE, BE IT RESOLVED by the Board of Township Trustees of Richfield Township, Summit County, Ohio, that:
SECTION ONE. The Board of Township Trustees is hereby authorized to enter into a Right-of-Way Use Agreement with Metricom, Inc., a copy of which Agreement is attached to this Resolution as Exhibit A and is incorporated into this Resolution by reference.:
SECTION TWO. It is found and determined that all formal actions of the Board of Township Trustees concerning and relating to the adoption of this Resolution were adopted in an open meeting of the Board of Township Trustees, and that all deliberations of the Board of Township Trustees and of any of its committees or subcommittees that resulted in such formal action, were in meetings open to the public in compliance with all legal requirements including Section 121.22 of the Ohio Revised Code.
SECTION THREE. This Resolution shall take effect and be in force from and after the earliest period allowed by law.
