WHEREAS, the Township entered into a Consent Judgment Entry (“Entry”) in the above referenced matter which was filed on June 1, 2000.

WHEREAS, the Township has received complaints from the residential property owners neighboring the property which is the subject of the Entry regarding the industrial and manufacturing activities being conducted on that property because of the close proximity of the operations and the neighboring residences.

WHEREAS, the relocation of the operations in question to an area which does not abut residential property will alleviate the property owners’ concerns and the parties to the Entry desire to relocate the operations to such a light- industrial/office zoned location.

WHEREAS, the Landowner, JJJ Properties has represented that the relocation of these operations and the acquisition of the property to which the operations will be moved involve significant costs and the Landowner has requested a longer agreed term to conduct the operations given these costs.

WHEREAS, Section III of the Entry provided that the Entry could be modified upon the consent of the parties and the parties do consent to the modification of the Entry to provide for, among other things, the relocation of the operations, including only a concrete batch plant, to a light-industrial/office zoned parcel within the Township.

NOW, THEREFORE, BE IT RESOLVED, by the Board of Trustees of Richfield Township, Summit County, Ohio, that the Township, by and through John P. Slagter as Special Counsel, is authorized to enter into the Modifications To Consent Judgment Entry Filed June 1, 2000, in substantially the same form as attached hereto and incorporated herein as Exhibit A, incorporating four issues discussed at the meeting on March 11, 2002, and Exhibit B – site plan.
