2003 ORGANIZATIONAL RESOLUTION

WHEREAS, effective 8-12-03 Summit County Council Resolution #2003-429, a substitute Ordinance ordering the erection of a new township, Richfield Township, as set forth in Ohio Revised Code Section 503.09 through 503.12, for Council, and declaring an emergency was enacted  (see Attachment ‘A’); and,

WHEREAS, effective 8-12-03  Summit Council Resolution #2003-578 confirmed the appointments to serve as Township officers as follows: Laurie Peters Gilmore, Shano Cica-Mraz and David Wyatt as Trustees through December 31, 2003 and Laurie Pinney as Clerk until March 31, 2004  (see Attachment ‘B’); and,

WHEREAS, the Board of Trustees of new Richfield Township may make rules and regulations which are necessary for the government of the Board, the Township, its employees and the use and protection of Township property; and,

WHEREAS, the following rules, regulations, and provisions contained herein this Resolution and any amendments thereto, will apply for the balance of calendar year 2003,

NOW, THEREFORE BE IT RESOLVED,

I.    TRUSTEES

        A.    Compensation for the Board of Township Trustees shall be based on an annual salary to be paid in equal monthly payments in accordance with Ohio Revised Code 505.24, payable monthly.

        B.    The Board of Trustees shall hold two (2) Regular Meetings each month. Said meetings are generally held at 7:00 p.m. at Richfield Town Hall on the first and third Thursdays for each month.

C.        The separate areas of Trustee responsibility shall be as follows:

             1.      Trustee Laurie Peters Gilmore: shall serve as Trustee liaison for the Road Department, Parks/Recreation and Service, Road and Capital Improvement Grant Projects.

2.      Trustee David Wyatt: shall serve as Trustee liaison for Workers Compensation, Insurance, OSHA and Richfield Village Liaison.

3.      Trustee Shano Cica-Mraz shall serve as Trustee liaison for all Zoning                         matters and the Police and Fire Departments.

        D.    Expenses of the Trustees and Clerk while in attendance at the annual summer convention or specially called meetings of the State or County township Associations shall be paid from General Funds of the Township.  Receipts are required.

        E.    Part-time Township Administrator, Linda Bowmer, will be compensated at $16.00 per hour up to 50 hours per pay period.  Hours to be determined.

        F.  Full time Administrative Assistant, Jan Buzzelli, will be compensated at a rate of $13.00 per hour. 

        G.    First Merit Bank will serve as public depository during the period of April 21, 2002 to April 20, 2007 inclusive.  The Clerk Treasurer shall manage all public funds in accordance with Resolution #04-2003.  Investment Policy recorded with the Ohio Auditor of State.

        H.    All current employees are at will employees.

        I.    Agent for General and Public Official Liability, Property, Auto and Excess Liability Insurance is Wichert Insurance Agency.  Agent for employee health, life, vision and dental is Burnham & Flower Insurance Agency.

        J.    Expense Reimbursement:  In accordance with the Ohio Administrative Code 3309-1-52, the following shall be made record.  Mileage rate is set at the current IRS rate for travel outside the township for township business in personal vehicles for all employees, elected or appointed.

            Reimbursement expenses shall include, but not be limited to, transportation, parking costs, lodging at single occupancy rate, meals and beverages in reasonable amounts, tips not to exceed fifteen per cent (15%), telephone calls related to Township business and registration fees.  Receipts are required.

            Final approval for reimbursement shall be at the discretion of the Board of Trustees with the clerk's attestation of available funds.

K.    Ratify the permanent 2003 budget adopted by the Trustees on July 28, 2003.

          L.            HOLIDAY SCHEDULE – 2003

      1.        01/01/03 New Years Day

      5.        09/01/03 Labor Day

In addition to the above listed holidays, employees will have two (2) floating holidays.  These holidays can be used as personal days with the approval of the supervisor of the department.  As much advance notice as possible would be appreciated for scheduling purposes.

II.    CLERK/TREASURER

A.  Compensation of the township Clerk/Treasurer shall be in accordance with the schedule by Ohio Revised Code 507.09 payable monthly.

          B.    The Clerk/Treasurer is authorized to implement intrafund transfers as revised expenditures demand and that exact details of such transfers be provided to the Board of Trustees at the following Regular Trustees Meeting.

III.    PERSONNEL POLICY AND EMPLOYEE BENEFITS

        A.    The Board of Trustees is adopting The Personnel Policies and Employee Benefits as set forth in the Employee Handbook adopted in Resolution 7-2001 and all subsequent amendments thereafter, and the Substance Abuse Prevention Program policy adopted July 9, 2001.

IV.    ROADS

        A.    A full-time Road/Service Foreman, Jerry Schall, will be compensated at the rate of $17.50 per hour.

        B.    Full-time road/service casual laborers Phil Hrusch will be compensated at the rate of $16.50 per hour, and Jason Mays will be compensated at the rate of $13.50 per hour.

        C.    Due to the nature of the job, road employees may not schedule extended vacations of more than one consecutive day between November 15 and March 31.  Vacations must be approved by the Township Administrator.

        D.    EMERGENCY CALLS will be paid a two (2) hour minimum.

        E.    Uniforms for full-time Road Department personnel shall be provided for through a contract with a uniform provider.  The use of steel-toed boots is required.  An annual clothing allowance not to exceed $375 will be provided to each road department employee.

        F.    The Board of Trustees may contract for the labor and materials necessary for maintaining Township roads and other Township property.  Such maintenance shall include, but not be limited to, snow removal, ditching, lawn service, control of surface and subsurface drainage, repair and resurfacing of roads, drives and parking areas.

        G.    Road maintenance by County of Summit Engineer:  Continuance of contract dated 01/01/72 and amended on the basis of labor and material costs.

V.     PARKS

        A.    Rising Valley Park will receive $6,000 for maintenance expenses and up to $25,000 for capital improvements.

        B.    The Board of Trustees may contract for the labor and materials necessary for maintaining Township property.

        C.    Rising Valley Park Board will meet on the third Tuesday of each month at 6 p.m. at the Park.

VI.    ZONING

        A.    The Richfield Township Zoning Resolution adopted on November 7, 1950 and all subsequent amendments thereafter, shall continue to regulate all Richfield Township zoning matters.

        B.    Fee schedule for 2003 as per attached schedule.

         C.  Laurie Pinney, Zoning Inspector/Director of Planning & Zoning, will be compensated at a rate of $16.50 per hour, up to 60 hours per pay period.  Hours to be determined.

VII.    ZONING BOARDS AND COMMISSIONS:  COMPENSATIONS AND SCHEDULE

        A.    Members of the Zoning Commission and Board of Zoning Appeals shall be paid a per meeting fee for their attendance at each legally constituted hearing or meeting of their respective bodies from the fees collected by the Zoning Inspector for Zoning Permits, Zoning Appeals and Rezoning Hearings.  Up to sixty percent (60%) of the fees collected in Account 13-A shall be used to reimburse commission and board members for the time, expenses and inconvenience involved in the rendering of the professional services, distributed as follows:  Zoning Commission and Board of Zoning Appeals members -- twenty-five dollars ($25) per meeting.  The balance of the fees collected shall remain in the Zoning Department accounts for Zoning Department expenses.

        B.    MEETING SCHEDULE:  The Zoning Commission shall hold regular monthly meetings at a time and date to be determined. This schedule is subject to change as zoning matters demand.  The Board of Zoning Appeals shall hold its meetings the third Monday of each month at 7:00 p.m. or as applications require.

VIII.   FIRE & RESCUE SERVICES

        A.    Contract with Village of Richfield is for a period beginning March 1, 2001 and continuing to February 29, 2004 for the annual sum of $240,000.

        B.    Contract with Joseph Stopak for the Township Fire Prevention Officer in the annual amount of $1,248 with contract expiring 12/31/03.  He shall attend the first regular Trustee’s Meeting of each month with a written report documenting the number and type of calls and inspections for the previous month, verbal synopsis of fire/EMS-related updates and/or information, and detailed written reports on the cause, origin and circumstance of each fire in the unincorporated area of Richfield Township where property is destroyed or damaged.

IX.    POLICE SERVICES

        A.    A contract with the Village of Richfield is for a period beginning October 1, 2002 and continuing to September 30, 2003 for the annual sum of $341,250.  Oct 1, 2003 – Sep 30, 2004 for the annual sum of $358,312.50.

X.    RUBBISH AND RECYCLING SERVICES

       A.    J & J Refuse, A Kimble Company. -- three year contract with an additional two-year option.
