A RESOLUTION OF THE RICHFIELD TOWNSHIP BOARD
OF TRUSTEES TO AUTHORIZE THE TERMINATION OF THE RISING VALLEY PARK BOARD, THE
ACCEPTANCE OF FEE TITLE TO
+/- 44.7 ACRES OF LAND, THE DONATION OF +/- 183.3 ACRES OF LAND TO THE CLEVELAND
METROPOLITAN PARK DISTRICT AND THE GRANTING OF A PERPETUAL EASEMENT TO THE
CLEVELAND METROPOLITAN PARK DISTRICT
WHEREAS,
Richfield Township and Hinckley Township jointly own the +/- 228 acre Rising
Valley Park, which was transferred jointly to Richfield Township and Hinckley
Township by the United States in 1977; and
WHEREAS,
the development and maintenance of the Rising Valley Park has been overseen
by a joint recreational board known as the Rising Valley Park Board pursuant to
the terms and conditions of the Cooperative Agreement dated February 2, 1978
between the Board of Trustees of Richfield Township and the Board of Trustees of
Hinckley Township; and
WHEREAS,
funding for the maintenance and capital improvement of the Rising Valley
Park has been provided, in part, through annual contributions of $6,000 per year
by each of the townships; and
WHEREAS,
the Richfield Township Trustees find it in the best interest of Richfield
Township to authorize and carry out a plan to terminate the Cooperative
Agreement, dissolve the Rising Valley Park Board, and provide for the separate
maintenance of that +/- 44.7 acre portion of the Rising Valley Park located
within Richfield Township; and
WHEREAS,
the Richfield Township Trustees find it in the best interest of Richfield
Township to donate the remaining +/- 183.3 acre portion of the Rising Valley
Park located within Hinckley Township to the Cleveland Metropolitan Park
District, and to grant the Cleveland Metropolitan Park District a perpetual
easement to access and maintain such property, including a trailhead parking
area for +/- 10 cars near an existing sledding hill located within Richfield
Township; and
WHEREAS,
the transfer of some or all of the Rising Valley Park property requires the
approval of the United States Secretary of the Interior;
NOW, THEREFORE,
be it resolved, by the Board of Trustees of Richfield Township, Summit
County, Ohio, that the Township, by and through Trustee Shano Cica-Mraz, or any
other member of the Board of Trustees of Richfield Township, is authorized to
take such necessary actions to terminate the Cooperative Agreement and dissolve
the Rising Valley Park Board;
FURTHER RESOLVED,
that Trustee Shano Cica-Mraz, or any other member of the Board of Trustees
of Richfield Township, is authorized to take such necessary actions to complete
and execute the transfer to Richfield Township of that +/- 44.7 acre portion of
the Rising Valley Park located within Richfield Township and to provide for the
maintenance of such property.
FURTHER RESOLVED
that Trustee Shano Cica-Mraz, or any other member of the Board of Trustees
of Richfield Township, is authorized to take such necessary actions to complete
and execute the donation of the +/- 183.3 acre portion of the Rising Valley Park
located within Hinckley Township to Cleveland Metroparks and to grant Cleveland
Metroparks a perpetual easement to access and maintain such property, including
a trailhead parking area for +/- 10 cars near an existing sledding hill located
within Richfield Township.
FURTHER RESOLVED,
that Trustee Shano Cica-Mraz, or any other member of the Board of Trustees
of Richfield Township, is authorized to take such necessary actions to obtain
the approval of the United States Secretary of the Interior for the actions
authorized herein.
