RESOLUTION #02-2004

A RESOLUTION OF THE RICHFIELD TOWNSHIP BOARD OF TRUSTEES TO AUTHORIZE THE CONVEYANCE OF REAL PROPERTY TO THE VILLAGE OF RICHFIELD IN ACCORDANCE WITH THE SEPARATION OF THE VILLAGE OF RICHFIELD FROM RICHFIELD TOWNSHIP

WHEREAS, The Township owns certain real property in Summit County, Ohio, located within the Village of Richfield and known as Permanent Parcel Nos. 50-01602 (Fellowship Hall), 50-01335, 50-01916 (3903 Broadview Road), 50-01324, 50-01917 (3907 Broadview Road), 50-01527, 50-01349, 50-01350, 50-02576, and 50-01526 (4410 West Streetsboro Road – Town Hall), 50-01044 (Richfield Park, Corner of Routes 21 and 303), collectively, the “Property” and

WHEREAS, Judge John Adam’s decision in Summit County Common Pleas Court Case No. CV99-07-2672 ordered the separation of the Village of Richfield from Richfield Township and this decision was affirmed by the 9th District Court of Appeals; and

WHEREAS, Summit County Council, acting pursuant to the above court orders, created a new Richfield Township after separating the Village of Richfield which required the allocation of existing indebtedness between the newly created Richfield Township and the Village of Richfield; and

WHEREAS, Summit County Council in Ordinance No. 2003-429 ordered that in satisfaction of the allocation of indebtedness between the new Richfield Township and the Village of Richfield that the new Richfield Township transfer the “Property” to the Village of Richfield.

NOW, THEREFORE, be it resolved, by the Board of Trustees of Richfield Township, Summit County, Ohio, that the Township, by and through the Members of the Board of Trustees, is hereby authorized to execute an Quit Claim Deed or Deeds to convey Richfield Township’s interest in the “Property”.

FURTHER RESOLVED, the any Member of the Board of Trustees, the Township Clerk or the Township Office Administrator are hereby authorized to execute any and all other documents necessary to effectuate the purposes of this Resolution.
