Resolution/Certification of Authority to Acquire Property
(Richfield Township)


Whereas, certain real property formerly owned by the United States of America, located in Richfield Township (Summit County) and Hinckley Township (Medina County), State of Ohio, was declared surplus in 1977 and was transferred by Quitclaim Deed recorded on January 5, 1978 in Volume 6025, at Page 342 of Summit County, Ohio, Records and recorded on December 13, 1977 in Volume 502, at Page 26 of Medina County, Ohio Records to the Township of Richfield, Summit County, Ohio (“Richfield Township”) and the Township of Hinckley, Medina County, Ohio (“Hinckley Township”), as authorized by the Secretary of the Interior for disposal as public park or public recreational purposes under the provisions of 40 United States Code Section 550(e) and any regulations and policies promulgated pursuant thereto, being known as Rising Valley Park and more particularly described as being formerly a portion of Cleveland Army Tank Automotive Plant Proving Ground, Summit and Medina Counties, Ohio, under the administrative jurisdiction of the Department of the Army, an agency of the United States Government, comprised of approximately 227 acres, and identified as General Services Administration Center Number D-OHIO-439C.

Whereas, Rising Valley Park (see Vicinity Map, page 1A) is a parcel of land with approximately 44 acres within Richfield Township (the “Richfield Property”) and approximately 183 acres within Hinckley Township (the “Hinckley Property”), and because of the unique natural resource amenities of Rising Valley Park, there is unanimous agreement between Richfield Township, Hinckley Township, and the Board of Park Commissioners of the Cleveland Metropolitan Park District (“Cleveland Metroparks”) to transfer the Richfield Property from Richfield Township and Hinckley Township to Richfield Township and to transfer the Hinckley Property, together with perpetual easement for access thereto, from Richfield Township and Hinckley Township to Cleveland Metroparks (see Park Acquisition Map).

Whereas, each of Richfield Township and Cleveland Metroparks needs and will use the Richfield Property and the Hinckley Property, respectively, in perpetuity for public park or recreational purposes as set forth in its application and in accordance with the requirements of said Act and any regulations and policies promulgated thereunder;

Now, Therefore, Be It Resolved, that each of Richfield Township, Hinckley Township, and Cleveland Metroparks shall make application to the National Park Service for, and secure the transfer of, a portion of the above-mentioned Rising Valley Park to each of Richfield Township and Cleveland Metroparks, as hereinabove described, for said use and subject to such exceptions, reservations, terms, covenants, agreements, conditions, and restrictions as the National Park Service and the Federal disposal agency may require in connection with the disposal of said property under said Act and the regulations and policies issued pursuant thereto.

Be It Further Resolved, that Richfield Township has legal authority, and is willing and able, to properly develop, maintain, operate, and assume liability of the property, and that David R. Wyatt, Township Trustee, is hereby authorized, for and on behalf of Richfield Township to do and perform any and all acts and things which may be necessary to carry out the foregoing resolution, including the preparing, making, and filing of plans, applications, reports, and other documents, the execution, acceptance, delivery, and recordation of agreements, deeds, and other instruments pertaining to the transfer of said property, including the filing of copies of the application and the conveyance documents in the records of the governing body, and the payment of any and all sums necessary on account of the purchase price thereof or fees or costs incurred in connection with the transfer of said property for survey, title searches, recordation or instruments, or other costs identified with the acquisition of said property.
