The Board of Township Trustees of Richfield Township, Ohio met in regular session on August 17, 2006 at 7:00 p.m., at 4410 West Streetsboro Road, Richfield, Ohio 44286, with the following members present:

Ms. Gilmore moved the adoption of the following resolution and David Wyatt seconded the motion:


RESOLUTION NO. #12-2006

A RESOLUTION DETERMINING TO PROCEED WITH THE SUBMISSION TO THE VOTERS OF THIS TOWNSHIP THE QUESTION OF ISSUING BONDS AND LEVYING A TAX FOR THE PURPOSE OF CONSTRUCTING, FURNISHING, AND EQUIPPING A TOWN HALL AND OFFICES FOR TOWNSHIP, PARK, AND RECREATIONAL ADMINISTRATION, AND IMPROVING AN EXISTING SITE OR ACQUIRING AND IMPROVING A SITE FOR THE TOWN HALL AND OFFICES.

BE IT RESOLVED by the Board of Township Trustees, Richfield Township, County of Summit, State of Ohio:

Section 1. Findings and Determinations. This Board makes the following findings and determinations:

(a) This Board adopted its Resolution No. 11 (the “Resolution of Necessity”) on July 20, 2006, declaring it necessary to issue bonds (the “Bonds”) for the purpose of constructing, furnishing, and equipping a town hall and offices for township, park, and recreational administration, and improving an existing site or acquiring and improving a site for the town hall and offices.

(b) The Summit County Fiscal Officer has certified to this Board that the annual average property tax levy throughout the life of the Bonds that would be required to pay debt charges on the Bonds, based on the assumptions in the Resolution of Necessity, is .5 mills for each one dollar of tax valuation, which amounts to five cents ($0.05) for each one hundred dollars of tax valuation.

(c) This Board determines to proceed with submitting the question of the issuance of the Bonds and the levy of a tax to pay the debt charges on the Bonds, to the voters of this Township at the November 7, 2006 general election.

(d) All formal actions of this Board relating to the adoption of this resolution were taken in an open meeting of this Board, and all deliberations of this Board and of any of its committees that resulted in those formal actions were in meetings open to the public, in compliance with all legal requirements including Section 121.22, Revised Code.

Section 2. Board of Elections Filing. This Board authorizes and directs the Fiscal Officer of this Board to file with the Summit County Board of Elections, not later than August 24, 2006, a copy of this resolution, a copy of the Resolution of Necessity, and a copy of the County Fiscal Officer’s certification as to the estimated average annual property tax levy. This Board requests the Board of Elections to prepare the ballots and make other necessary arrangements for the submission of these questions to the electors of the Township, all in accordance with law.

Section 3. Effective Date. This resolution shall be in full force and effect immediately upon its adoption.
