RESOLUTION #06 –2006



Ms Gilmore moved the adoption of the following resolution:

BE IT RESOLVED by the Board of Trustees of Richfield Township that:

SECTION 1: This Board ratifies and confirms the creation of the Richfield Township Fire District, consisting of the entire territory of Richfield Township.

SECTION 2: This Board finds and determines that:

(a) The amount of taxes that may be raised within the ten-mill limitation will be insufficient to provide an adequate amount for the necessary requirements of the Richfield Township Fire District.

(b) It is necessary to levy a tax in excess of the ten-mill limitation for the purpose of providing fire-fighting and emergency medical services, by contracting with other fire-fighting agencies or by providing those services directly, including fire apparatus and buildings and payment of firefighters or firefighting companies.

(c) The existing 2.72 mill levy for that purpose will last be collected in 2006.

(d) This Board proposes replacement of the 2.72 mill levy with a decrease of .52 for a total of 2.2 mills at the rate at which it is authorized to be levied.

SECTION 3: The question of the replacement of the necessary levy for the purpose of providing funds for fire/EMS protection will be submitted to the electors of the Richfield Township Fire District at the election to be held on May 2, 2006.

SECTION 4: The ballot form for the election must be as follows:

RICHFIELD TOWNSHIP FIRE DISTRICT

A MAJORITY AFFIRMATIVE VOTE IS NECESSARY FOR PASSAGE

A replacement of the 2.72 mills tax with a decrease of .52 for a total of 2.2 mills for the benefit of the Richfield Township Fire District for the purpose of providing fire-fighting and emergency medical services, by contracting with other fire-fighting agencies or by providing those services directly, including fire apparatus and buildings and payment of firefighters or firefighting companies at a rate not exceeding 2.2 mills for each one dollar of valuation which amounts to 2.2 cents for each one hundred dollars of valuation for three years, commencing in 2006, first due in calendar year 2007.

SECTION 5: The Board authorizes and directs the Fiscal Officer to certify a copy of this Resolution to the Board of Elections of Summit County immediately after passage for the submission of the ballot question herein contained to the electors of the Richfield Township Fire District in accordance with Sections 5705.19(I) and 5705.192, Revised Code.

SECTION 6: All formal actions of the Board concerning and relating to the adoption of the Resolution were taken at an open meeting of this Board and all deliberations of the Board and of any of its committee that resulted in such formal action were in meetings open to the public in compliance with all legal requirements.

SECTION 7: The Resolution shall go into immediate effect upon its passage and no publication of it is necessary other than the notice of election.
