WHEREAS, Janlin Company LLC of 3030 West Streetsboro, Richfield, Ohio 44286 has made an application for conditional use approval to modify a previously approved layout, increased the number of employees and grant a variance for the number of parking spaces to be ‘banked’ for a commercial use in a C-1 district for property located at 3018/3030 W. Streetsboro Road, Richfield, Ohio;

WHEREAS, notice of a public hearing was published in a newspaper of general circulation in the county of Summit on January 10, 2008 and a public hearing was held on January 21, 2008;

WHEREAS, the Richfield Township Board of Zoning Appeals, hereafter referred to as the “Board”, finds the application to be as aforesaid;


WHEREAS, the Board has marked the following exhibits: BZA 556-08-A, a memorandum entitled “Site Development Narrative for 3030 West Streetsboro Road prepared by Thorson Baker & Associates, Inc. dated January 7, 2008; BZA 556-08-B a two page set of plans entitled C-1 Overall Site Plan and C-2 entitled Site Preparation Plan and further identified as “Job. No. 2007-0759; Date: 1/7/08; BZA 556-08-C a one page plan entitled C-1 Overall Site Plan and C-2 entitled Site Preparation Plan and further identified as “Job. No. 2007-0759; Date: 1/7/08 and revised on January 17,2008; and BZA 556-08-A, a memorandum entitled “Site Development Narrative for 3030 West Streetsboro Road prepared by Thorson Baker & Associates, Inc. dated January 17, 2008;

WHEREAS, the Board finds that the owners of the property had previously been granted a Conditional Use Permit with stated conditions, per Resolution #429, dated August 19, 1997; a Conditional Use Permit for an expansion of the building facilities on the property per Resolution #469 dated June 26, 2000; a Conditional Use Permit for a further expansion of the facilities on the property per Resolution #536 dated May 2006; and an expansion of the Conditional Use Certificate and variance for parking requirements per Resolution 544—07 effective February 26, 2007.

WHEREAS, the Board finds that this is an application for an expansion of a Conditional Use Permit that would allow an addition of 21,545 gross square feet and an encroachment by the addition into the 200 side yard setback on the west side of the property (and having a side yard setback of 94.43 feet); 

WHEREAS, the Board finds that parking requirement for the property per the Richfield Township Zoning Resolution is 352 spaces (1 parking space for each 150 square feet of floor area for 264 spaces, plus 1 space for every 2 employees for 88 spaces) and the applicant is proposing a reduction in spaces to 177 current spaces and 175 land banked spaces;

WHEREAS, the applicant has testified that 177 current parking spaces will accommodate the parking needs of the property and the operation and that parking in excess of the 177 spaces will not be required to accommodate their needs;

WHEREAS, the side yard setback for the proposed addition will be less than the 200 foot requirement, but is more than the 67 foot side yard set back approved in BZA Resolution 536-06.   

WHEREAS, the Board finds that the proposed expansion of the Conditional Use Permit not to be in violation of the General Standards of the current Zoning Resolution Township, Article VII, Section 702-2;

WHEREAS, the Board finds that the proposed reduction in parking spaces not to be contrary to public interest;

WHEREAS, the Board finds that the proposed reduction in parking spaces not to be detrimental to the health, safety and well-being of the community;

WHEREAS, there are no opponents to the application;


NOW, THEREFORE BE IT RESOLVED, that the application of Janlin Company LLC for a an expansion of the Conditional Use Permit and a variance to reduce the number of required parking spaces from 362 to 177 (with an additional 175 land banked) for the property at 3030 W. Streetsboro Road, Richfield, Ohio be GRANTED under the following conditions:

CONDITION NO. 1: The scope and specifications for the proposed expansion shall remain substantially unchanged from those outlined on Exhibit BZA 556-08-C, except that there shall not be any paving in any 50 foot setback and this shall be depicted on a revised plan to be approved by the BZA.

CONDITION NO. 2: The Richfield Board of Zoning Appeals must approve any and all of changes in size, general configuration or propose additions to the parking area, signage, outdoor lighting or other matters depicted or described on Exhibit 556-08-C.

CONDITION NO. 3: The applicant must remove the un-permitted storage trailers located on the property prior to completion of construction pursuant to this Resolution.

CONDITION NO. 4: The applicant will be considerate of the impact of noise during construction on adjoining property owners.

CONDITION NO. 5: All prior conditions in prior Resolutions (where relevant) shall continue to apply.

CONDITION NO. 6: The area described as “Land Banked” spaces on BZA 556-08-B shall not be used or converted to another use other than the current use (green space) or parking without the prior approval of the Board. 

CONDITION NO. 7: The Conditional Use Permit and variance are subject to amendment or termination in the event that there is a material change in the current use of the property.

CONDITION NO. 8: In the event the number of employees or other users of the property exceed 175, then the property owner shall increase the number of parking spaces in proportion to the ratio currently granted, which spaces shall be located as shown on BZA 556-08-C. 

CONDITION NO. 9: The property shall be re-consolidated into one parcel.

CONDITION NO. 10: There shall be no paving within any setback.

CONDITION NO. 11: There shall be landscaping on the north and west ides of the property which shall be depicted on a plan to be approved by the BZA prior to the completion of construction.
